Who decides what is or is not 'over the top' and why should their criteria be used vs someone else's?

When I mean "over the top," I just mean excessive. So, like, if they're there for the sake of making the story "mature" and there to shock the audience, then it will come across as juvenile and the very opposite of dark and mature. The 2018 horror video game Agony and other works like it suffer from that kind of issue a lot.
